These Terms of Use ("Terms") govern your access to and use of the Tayib mobile application ("App") and the Tayib website (tayib.app) (collectively, the "Services") developed and operated by Pierre André Bossetti Gutierrez ("we," "us," or "our").
1. Acceptance of Terms & Eligibility
You agree that by downloading, installing, accessing and/or using the Services, you have read, understood, and agreed to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
By using the Service, you affirm that you are of legal age to enter into these Terms, or, if you are not, that you have obtained parental or guardian consent to enter into these Terms and your parent or guardian consents to these Terms on your behalf.
2. Account Registration and Accuracy
If you create an account or join a waitlist, all information that you provide to us must be true, current, complete, and accurate, and you must notify us immediately of any changes.
3. Changes to Terms
We reserve the right, in our sole discretion, to make changes or modifications to these Terms from time to time. The updated version will be indicated by an updated "Effective Date" at the top of these Terms. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms by your continued use of the Services after the date such revised Terms are posted.
4. Services Functionality & AI Usage
Our Services provide various functionalities, including AI-based food ingredient scanning, access to content, waitlist registrations via our website, and in-app purchases. We reserve the right to modify, suspend, or discontinue any part of the Services at any time without notice.
Because our App utilizes third-party artificial intelligence, you must not use the AI Products in any way that violates the terms or policies of any AI Service Provider.
5. Crucial Dietary, Religious, and Medical Disclaimer
Tayib utilizes Artificial Intelligence and external databases to analyze food ingredients, E-numbers, and potential Haram components (such as pork or alcohol). However, AI and databases can make mistakes, and manufacturer recipes change frequently.
- Not a certification: Tayib is an informational tool, not an official Halal certification body.
- Allergies and Health: The App must not be relied upon for critical health decisions, including severe food allergies.
- Final Verification: You agree that you must ALWAYS verify the physical packaging, ingredient list, and official certifications on the product itself before consumption.
We assume no liability for any dietary, religious, or medical infractions, allergic reactions, or health issues resulting from the use of the App.
6. Intellectual Property
All intellectual property rights in the Services and its content (including design, text, graphics, logos, images, AI models, and software) are owned by Pierre André Bossetti Gutierrez or our licensors.
Users are not permitted to alter, decompile, reverse-engineer, decrypt, or otherwise manipulate the App’s or Website's code to uncover underlying algorithms, create derivative works, or use it for commercial purposes without prior written permission.
7. User Conduct
You agree to use our Services only for lawful purposes. Prohibited conduct includes, but is not limited to:
- Violating any applicable laws or regulations.
- Automating requests, scraping data, or trying to bypass our security measures.
- Interfering with or disrupting the App, Website, AWS servers, or networks connected to the Services.
8. In-App Purchases and Subscriptions
Our App offers auto-renewing subscriptions (e.g., Tayib Pro) to access premium features. All payments are processed securely through the Apple App Store.
- Payment: Payment will be charged to your Apple ID account at the confirmation of purchase.
- Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
- Cancellation: You can manage and cancel your subscriptions by going to your App Store Account Settings after purchase. We utilize RevenueCat for subscription management.
9. Disclaimer of Warranty & Limitation of Liability
Our Services are provided "as is" without any warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be error-free, uninterrupted, or perfectly secure.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill resulting from your access to or use of the Services.
10. Miscellaneous
- Entire Agreement: These Terms constitute the entire agreement between you and us concerning this subject matter.
- Waiver: Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.
- Severability: If any provision of these Terms is found to be invalid, the remaining provisions shall not be affected thereby and shall continue in full force and effect.
- Relationship: There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Terms or your use of the Services.
11. Governing Law & Contact
These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.
