These Terms of Use (« Terms ») govern your access to and use Tayib mobile application (« App ») developed by Pierre André Bossetti Gutierrez (« we, » « us, » or « our »).

1. Acceptance of Terms

By downloading, installing, or using our App, you acknowledge that you have read, understood, and agree to these Terms of Use.

2. Changes to Terms

We may modify or update these Terms at any time, with or without notice. Your continued use of the Apps after any changes constitutes your acceptance of the new Terms.

3. Privacy Policy

Our Privacy Policy explains how we collect, use, and share your information when you use our Apps. By using the App, you consent to our data practices as outlined in the Privacy Policy.

4. App Functionality

Our App provide various functionalities, which may include (but are not limited to) providing access to content, enabling user interactions, offering in-app purchases, and utilizing device features. Specific functionalities may vary depending user features requests.

5. Intellectual Property

All intellectual property rights in the App and its content (including but not limited to design, text, graphics, logos, images, and software) are owned by us or our licensors.

The UI, source code, and object code of the App, along with its content—except for user-generated content (UGC)—are the intellectual property of Pierre André Bossetti Gutierrez.
Users are not permitted to alter, decompile, reverse-engineer, decrypt, or otherwise manipulate the App’s code to uncover its underlying algorithms, create derivative works, or use it for any purpose beyond its intended functionality, unless prior written permission is granted.
Reproducing or distributing the App for commercial purposes, including incorporating it into software bundles, whether for free or for a fee, is prohibited without prior written approval.
The exclusive content within the App may only be used as intended—specifically, on the User’s device for personal, non-commercial use. Any redistribution, sharing, or repurposing of this exclusive content is not allowed.

6. User Conduct

You agree to use our App only for lawful purposes and in a manner that does not infringe the rights of, restrict or inhibit the use and enjoyment of the App by any third party. Prohibited conduct includes, but is not limited to:

Violating any applicable laws or regulations.
Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
Interfering with or disrupting the App or servers or networks connected to the Apps.
Uploading or transmitting any viruses, worms, defects, Trojan horses, or other items of a destructive nature.
Using the Apps to violate the privacy of others or collect personal information without consent.

7. In-App Purchases and Payment Processing

Some Apps may offer in-app purchases and subscriptions.

All payments and transactions are processed securely through the Apple App Store.
We utilize RevenueCat for subscription and entitlement management. You are responsible for managing your in-app purchases and subscriptions directly with the app store.

8. Disclaimer of Warranty

Our App is provided « as is » without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free, uninterrupted, or secure.

We do not guarantee that the App will be suitable for any specific purposes, nor do We guarantee any specific results from using the App.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use the App;
Any conduct or content of any third party on the Apps;
Or unauthorized access, use, or alteration of your transmissions or content.

We are trying to keep the App’s maintenance 24/7, but sometimes it is impossible. We bear no responsibility for any delays, data losses, or errors that may occur in the Service’s capacity, nor will it bear any liability for any resulting consequences.

We are making our best efforts to keep User’s data safe, but no system is perfect, and we cannot guarantee that our security system will not be bypassed (including as a result of unlawful activity). We do not have any liability for consequences of such actions.

By downloading the app, user agrees that he is acting at his own risk and is liable for any possible consequences.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland.
